Jarrod Paul Lane, 35, 3690 Blytheburn Road, Mountaintop, has been charged with two counts of DUI and related offenses stemming from an incident that took place on October 20, 2017. Ptlm. Kevin Stahley of the Fairview Township Police Department filed the charges on November 2, 2017.
According to the Affidavit of Probable Cause, on October 20, 2017, Ptlm. Kevin Stahley was notified by Luzerne County 911 of an erratic driver of a Black Toyota Tacoma traveling south on South Main Road. The complainant reported that the vehicle was traveling on two flat tires, was sparking and was crossing into oncoming traffic lanes. The complainant followed the vehicle south on South Main Road providing updates to responding officers. She reported that the vehicle pulled into a driveway at 3690 Blytheburn Road.
A few minutes later, Rice Twp. Officer Andy Hashagen arrived on scene and observed a Toyota Tacoma with both its front and rear passenger tires shredded in the driveway. The officer observed a male suspect sitting in the driver seat and then observed the male suspect crawl over the center console and into the passenger side before exiting the vehicle from the passenger side, The officer detained the driver until Ptlm. Stahley arrived on scene,
Once on scene Ptlm. Stahley observed the vehicle had passenger front end damage on it along with damage to the hood. Stahley also observed a liter bottle of Mango Vodka that was 2/3 empty and had the cap off. Ptlm. Stahley went to speak with the male suspect and requested he produce his driver’s license. The subject produced a driver’s license with the named Jarrod Lane on it who will be referred to as the defendant.
The defendant reported that he was traveling south on South Mountain Blvd. when his vehicle veered from the travel lane and mounted a curb at Summit View Plaza 59 South Mountain Blvd. The defendant reported his vehicle struck two parking signs in the parking lot of Summit View Plaza. While speaking with the defendant, Ptlm. Stahley detected a strong odor of an intoxicating beverage coming from his breath. The officer also observed that the defendant’s eyes were blood shot and glossy and his speech was slurred. The defendant did admit to consuming the Mango vodka in his vehicle while he was driving from the Poor House in Ashley to his residence. Ptlm. Stahley requested Officer Hashagen to perform the SFST. Officer Hashagen had the defendant perform the HGN test and field sobriety tests. The defendant also provided a sample of his breath for a PBT and result was positive. He was arrested by Ptlm. Stahley for driving under the influence of alcohol. The defendant was transported to the Luzerne County DUI center for a chemical test of breath to determine his blood alcohol concentration. The defendant agreed to provide a sample of his breath for testing. The result was .201% which exceeds the Commonwealth’s legal Limit of 0.08%.
The officers transported the defendant to Griffith Lane in Wilkes-Barre. He was advised of the charges that would be filed and released to his mother, Laurie Lane.
Ptl. Stahley went to Summit View Plaza, 59 South Mountain Blvd., and observed a large debris field in the parking lot. Ptlm. Stahley was able to determine that the defendant’s vehicle veered from the right lane and mounted the curb causing the front passenger tire to blow out. The defendant’s vehicle continued to travel south on the curb with the passenger front end colliding with the two signs that were ripped out of the ground. The vehicle mounted a second curb causing the vehicle to go airborne and landing several feet away. The vehicle veered to the left and came to rest facing east in the northbound lane before fleeing the scene of the accident.
A preliminary hearing has been scheduled December 21, 2017 at 10 a. m. before Magisterial District Judge Ronald Swank.
