Dr. Mark Anthony Gonsky, 60, of Mountaintop, is confined in the Luzerne County Prison after his $20,000 bail was revoked on Friday, May 10 by District Magisterial Justice Ronald W. Swank.
In addition, the PA Department of State has listed Gonsky’s medical license as under suspension.
On Friday, Gonsky faced a Preliminary Hearing before Judge Swank on charges filed by Wright Township Patrolman David Winsock stemming from an incident that occurred on Monday April 29, when Gonsky was observed operating an ATV in an inebriated state at the Crestwood Plaza on Route 309.
The charges include counts of Driving Under the Influence of Alcohol; DUI –Highest Rate of Alcohol with a count of 0.189%, more than double the state legal limit of 0.08% BAC, and improper operation of the unlicensed and un-insured ATV.
These charges follow multiple counts brought by Fairview Township police after a series of incidents on February 24th, including Terroristic Threats, Recklessly Endangering and Disorderly Conduct. At a hearing on May 1st on the
Fairview complaint Gonsky’s attorney, Anthony J. Moses of Kingston, agreed to waive those charges to Luzerne County Court of Common Pleas.
Assistant District Attorney Jenny Roberts unsuccessfully urged the judge to revoke bail pending the receipt of the BAC official results on the April 29 DUI arrest.
On May 2, the BAC results were received and, at a hearing before District Judge Joseph A. Halesey, Gonsky was arraigned on the DUI charges. Judge Halesey imposed a bail of $20,000 and set other conditions
The Preliminary Hearing scheduled for Friday, May 10, was continued. Instead, a Bail Revocation Hearing took place resulting in the issuance of a warrant for confinement. Judge Swank advised, “The reason for the revocation is non-compliance with bail conditions.”
Gonsky was ordered to be incarcerated until a Preliminary Hearing can take place. It is scheduled for Wednesday, May 15.
